This Crew Contract (the “Agreement”) is made between you (the “Crew”) and Pangaea Exploration, LLC, a company registered at 2500 Swanson Ave, Miami, FL, 33133, USA (“Pangaea”). By booking a voyage and paying the deposit, you agree to the following terms and conditions:

1. Passage Fee & Payment Terms

1.1. The Crew agrees to pay a non-refundable deposit, as stated in the trip listing, upon booking to secure a berth aboard Sea Dragon or any other Pangaea vessel.

1.2. The remaining balance of the Passage Fee must be paid no later than 60 days before departure. If booking is made within 60 days of departure, full payment is due at the time of booking.

1.3. If the Crew fails to pay the balance by the due date, Pangaea may cancel the Crew’s berth, and the deposit will be forfeited.

1.4. The Passage Fee includes accommodation on board, meals, and participation in scheduled activities but excludes travel expenses to and from the embarkation/disembarkation ports.

1.5. Failure to comply with payment terms may result in forfeiture of the Crew’s place on the voyage, with cancellation policies in effect as stated in Section 2.

1.6. By proceeding with payment, the Crew acknowledges and agrees to the terms outlined in this contract. The Crew must check the acceptance box on the payment page before proceeding.

2. Refund & Cancellation Policy

2.1. The deposit is non-refundable, except under the cancellation terms outlined below.

2.2. If the Crew cancels their booking, the following refund policy applies based on the date of written cancellation notice received by Pangaea:

  • 60+ days before departure → Deposit forfeited, no further payment due.
  • 45–59 days before departure → Crew liable for 50% of the total Passage Fee.
  • 30–44 days before departure → Crew liable for 75% of the total Passage Fee.
  • Less than 30 days before departure → Crew liable for 100% of the total Passage Fee.

2.3. If Pangaea cancels or significantly modifies the voyage before departure, the Crew may:

  • Transfer their deposit to a future passage, subject to availability.
  • Receive a full refund, including the deposit.

2.4. No refunds or compensation will be given if the Crew:

  • Chooses to leave the trip early for personal reasons.
  • Misses the embarkation time or fails to board.
  • Is asked to leave the voyage due to a breach of contract (see Section 3).

2.5. Pangaea is not responsible for refunding costs related to travel, visas, or personal expenses in the event of cancellation. The Crew is strongly encouraged to obtain travel insurance covering trip cancellation.

3. Crew Responsibilities & Conduct

3.1. The Crew acknowledges that this is an active sailing experience and confirms they are in good physical health and fit for offshore sailing. The Crew agrees to disclose any medical conditions before booking and to complete the Medical Form honestly.

3.2. The Crew must comply with the safety rules and instructions of the skipper and crew at all times. The skipper has the right to deny participation in activities or remove any Crew member whose behavior endangers safety. The Crew agrees to follow all emergency procedures and wear safety equipment such as Personal Flotation Devices (PFDs), safety tethers, and harnesses when required. The Crew is responsible for ensuring their own safety by using the provided equipment correctly and following best seamanship practices.

3.3. The Crew shall not bring illegal substances, weapons, or prohibited items on board. Violation of this clause will result in immediate removal from the voyage without a refund. Prescription medications must be disclosed before departure and stored securely in the ship’s medical cabinet if required by the skipper.

3.4. The Crew understands that itinerary changes may occur due to weather, safety concerns, or operational needs, and Pangaea is not liable for any alterations to the planned schedule. The skipper has full discretion over route changes, harbor entries, and adjustments necessary for the safety of the Crew and vessel.

3.5. The Crew is expected to actively participate in all aspects of life aboard, including but not limited to:

  • Standing watch at designated times, including overnight shifts.
  • Hoisting, trimming, and reefing sails as directed by the skipper.
  • Navigating and helming when assigned, under supervision.
  • Cooking meals as part of a rotating schedule.
  • Cleaning and maintaining hygiene in common areas and personal spaces.
  • Assisting with docking, anchoring, and mooring operations.
  • Following team-oriented conduct, including treating all Crew members with respect regardless of gender, race, religion, or experience level.

3.6. The Crew must manage their own well-being, including hydration, sleep, nutrition, and appropriate clothing. Proper layering of clothing, securing adequate sleep during off-watch periods, and maintaining hydration are essential for safe participation. The Crew is responsible for bringing appropriate gear for varying weather conditions and should be prepared for exposure to extreme environments.

3.7. The Crew acknowledges that living conditions on board are close-quarters, requiring flexibility, teamwork, and cooperation. Privacy is limited, and Crew members are expected to maintain a respectful and positive attitude toward fellow Crew and the vessel’s leadership.

3.8. Pangaea reserves the right to terminate the participation of any Crew member who does not comply with this Agreement, displays disruptive behavior, fails to contribute to shipboard duties, or otherwise compromises the experience for other participants. No refunds will be provided in such cases.

4. Insurance & Liability

4.1. Pangaea carries third-party liability insurance for the vessel, but this does not cover personal injury, trip cancellation, or loss of personal property.

4.2. The Crew is responsible for securing their own travel insurance, including medical coverage and trip cancellation insurance.

4.3. Pangaea shall not be liable for any injury, illness, or loss sustained during the voyage unless due to gross negligence.

4.4. The Crew agrees to indemnify and hold harmless Pangaea, its officers, employees, and contractors from any claims arising from their participation in the voyage.

4.5. The Crew is responsible for securing all necessary passports, visas, and travel documentation for the destinations visited.

5. Miscellaneous

5.1. The Crew understands that they are joining a sailing expedition, not a charter, and will be expected to participate in sailing operations as part of the team.

5.2. Pangaea reserves the right to change pricing for future trips, but the Crew’s confirmed trip price will remain as agreed upon at booking.

5.3. This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or representations. Any disputes shall be governed by the laws of Florida, USA, with jurisdiction in Florida courts.

5.4. The Crew agrees that any photos or video recorded during the trip may be used by Pangaea for promotional and marketing purposes.

5.5. The Crew agrees to follow all local laws and customs in the destinations visited and abide by all entry and exit requirements.

I understand that by proceeding with payment, I agree to the terms outlined in this contract.
